Comworker Privacy Policy

This Privacy Policy pertains to the collection, use, disclosure, and retention of information that you, as a user of our Services or a visitor to our website www.comworker.com, provide to us and that is held and controlled by Solutions RSJ Inc. ("Comworker", "we," "us," "our").

Comworker complies with the law governing the protection of personal data in the private sector (RSQ, c P-39.1).

Comworker is committed to storing and processing your content and personal data on the highly secure servers of our provider Amazon Web Services (AWS), which holds several security certifications such as SOC 1-2-3, ISO 27001, and many others. Maintenance is provided by Comworker or by a third party on behalf of Comworker. Information collected on the website, including personal information, may be stored on secure servers located outside of Canada.

By using the Services, you are deemed to have read and understood the terms and conditions of this Privacy Policy. If you do not agree with this privacy policy, do not use the services. You can send your questions regarding this Policy to our Privacy Officer.

Definitions

The terms "Service," "Services," or "Services Comworker" may refer to the Comworker.com website, the application and software offering time sheet management, scheduling, expense report functionalities, as well as any other services offered and available from time to time through the Comworker.com Site.

The term "Contents" may refer to content such as data, text, images, contact information, and links to content submitted on Comworker.com as part of your use of the Service.

Collection of Personal Data

As part of providing the Services:

  • When you register with our services, Comworker collects your personal data. This information may include your name, email address, and passwords, as well as other personal information (collectively referred to as "Personal Data");
  • Comworker may also collect personal identification information from Visitors when they communicate with us about our Services or during their interactions with our Users;
  • Comworker collects information about your clients so that you can set them up in the system. This information may include their name, email address, postal address, and phone number;
  • We may collect information about your employees if you wish to add them to your account; in that case, we will collect their name, email address, phone number, occupation, and date of recruitment;

Use of Your Personal Data

Comworker will only use Personal Data for the following purposes:

  • Provide the Services you have requested;
  • Track hours by employee and by project, process payments and expenses, and generate reports;
  • Offer you services from Comworker that may be of interest to you; and
  • Comply with requests from authorities and legal obligations, in accordance with the law governing the protection of personal data in the private sector (RSQ, c P-39.1) and other applicable laws.

On rare occasions, when circumstances require it, we will send you service-related announcements. For example, if our service is temporarily suspended for maintenance reasons, we will likely send you an email.

Based on the personal data you have provided to us, we will send you a welcome email to verify your email address. We will also communicate with you in response to your queries, provide you with the requested services, and manage your account.

Comworker will only share your personal data with third parties as described in this privacy policy. We do not sell your personal data to third parties.

We may provide some of your personal information to companies that provide services to assist us in our business activities, such as sending emails on our behalf or providing customer service. These companies are authorized to use your personal data only to the extent necessary to provide us with the requested services.

We share some of your personal information with third parties in the following cases:

  • ActiveCampaign, for sending introduction and learning emails.
  • Postmark, for sending transactional emails.
  • Twilio, for SMS communication.
  • Google Analytics, for analyzing application usage patterns and improving our products.

Comworker may also use and disclose your personal data as required by law, such as in response to a subpoena or in any other legal proceeding, to investigate potentially fraudulent activities that may threaten the integrity of our Service or network and participate in preventing such activities, to investigate fraud or violations of our Terms of Service when we have reason to believe, in good faith, that such disclosure is necessary to protect our rights, or to ensure your safety or that of others, or to respond to a request from public authorities.

If we are involved in a merger, acquisition, or sale of all or part of our assets, you will be notified by email and/or a prominently placed notice on our website of any change in ownership or use of your personal data, as well as the choices available to you regarding that information.

Access and Rectification

You can access certain Personal Data that we keep, correct inaccuracies, delete inaccuracies, update, and rectify them by accessing your company's settings and your user profile. For more complex requests, please contact our Privacy Officer. We will respond to your request within 30 days.

Data Retention

We will retain your information for up to 7 years as long as your company account is active (payment enabled). To deactivate your company account and all its users, simply cancel your subscription from our Dashboard. We will retain and use your information as needed to comply with legal obligations, resolve disputes, and enforce our commitments. Data from an inactive account (no monthly subscription) will remain accessible for 30 days from the date of the last payment deadline. After this period, personal, company, and user account data will be permanently deleted or fully anonymized (irretrievable).

Cookies

The provision of Services requires the use of a cookie. A "cookie" is an information file that a website can place on your computer to facilitate or improve the use of our Services and website. If you choose to block cookies, you will not be able to use the services provided by Comworker. We do not associate the information stored in cookies with any personal data you provide during your visit to our site.

In addition to cookies, Comworker and third-party advertisers may also use third-party cookies to anonymously track and analyze online activity and the use of our Services, and to provide targeted advertisements. You can block or restrict the placement of third-party cookies by setting your preferences through our Cookie Consent Manager. If you refuse to use cookies that are not in the "strictly necessary" category, you will still be able to use the services provided by Comworker, but some features may be affected.

Your Content

If you protect the confidentiality of your access codes and/or passwords and adhere to this policy, only you and certain employees of Solutions RSJ Inc. will have access to your Content and your Personal Data. Users with whom you share Content will only have access to those you authorize them to view.

Security

The security of your personal data is important to us. We adhere to industry standards to protect the personal data that is transmitted to us during transmission and once it is in our possession. However, no mode of transmission over the Internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee the absolute security of your personal data. Comworker has deployed the following security measures:

  • Information transmitted from your browser to our servers is securely encrypted using SSL (Secure Sockets Layer) software;
  • Access control for employees working on our application;
  • Personal address and phone numbers data are stored in encrypted format (AES 256).

Comworker will continue to review its policies and implement additional security features as new technologies emerge. However, no system or service can guarantee 100% security, especially a service based on a public network such as the Internet. Therefore, the risk of third parties gaining unauthorized access to your data remains.

You must ensure the confidentiality of the access codes and/or passwords you use to access your account. You are responsible for all activities that occur under your account(s), and you must comply with all applicable laws in connection with your use of the Service, including those governing information privacy and personal data. You must immediately notify Comworker of any unauthorized use of any password or account, or any other actual or suspected security breach.

This site contains links to other sites that do not belong to us or that we do not control. Please be aware that we are not responsible for the privacy practices of these third-party sites.

We recommend that you identify when you leave our site and read the privacy policies of each website that collects your personal data.
